Kuwait reaffirms strong commitment to freedom of expression before UN Human Rights Council

Kuwait has reiterated its firm commitment to safeguarding freedom of opinion and expression within a legal framework that respects fundamental rights and aligns with international standards, according to Lafi Al-Subaie, representative of the Ministry of Information.

During Kuwait’s presentation of its fourth national report before the United Nations Human Rights Council, Al-Subaie emphasized that freedom of expression is protected under Article 38 of the Kuwaiti Constitution, reports Al-Rai daily.

He stated, “Media laws in Kuwait do not impose prior censorship on publications or media outlets. These laws aim to safeguard individual privacy and prevent violations of protected rights.”

Al-Subaie highlighted the country’s progress in enhancing freedoms, notably the amendment of the Press and Publications Law to abolish prior censorship on imported books.

This reform enabled greater participation in the 47th Kuwait International Book Fair, which hosted 544 publishing houses from 31 countries — 19 Arab and 12 foreign — and featured 243,000 book titles

Addressing the role of digital platforms, Al-Subaie noted that the 2016 Electronic Media Law ensures that content shared via websites and digital platforms is free from prior censorship.

The law also supports the growth and licensing of digital media, with 450 electronic media outlets currently licensed by the state.

He also discussed Kuwait’s efforts to modernize its media landscape through the proposed unified media regulation law, which is being developed in coordination with unions, federations, and civil society groups.

Key features of the draft law include:

  • Reducing custodial sentences for media-related offenses.
  • Streamlining licensing procedures for media and advertising professionals.
  • Integrating current media laws into a unified legislative framework.
  • Regulating social media influencers, particularly in commercial advertising.
  • Adapting to technological advancements, including the use of artificial intelligence in media.
  • Countering fake accounts and disinformation to protect the integrity of the digital space.

    Al-Subaie’s remarks underscored Kuwait’s approach to ensuring responsible freedom of expression while modernizing and regulating its media environment in step with global developments.
