Kuwait tightens rules on family names, limits use of ‘Al-’ to legal cases

New law regulates lineage claims, sets clear conditions for modifying family names and titles

In a step aimed at safeguarding legal identity and preventing the misuse of lineage, Kuwait’s new law regulating lineage claims and name corrections has introduced strict controls on the use of the definite article “Al-” in family names.

Minister of Justice Nasser Al-Sumait stated that adding “Al-” to the names of fathers or grandfathers, effectively transforming them into family titles, is considered a formal name amendment. As such, it is not permitted without approval from the competent committee and must be supported by official documentation.

He clarified that the law distinguishes between informal and official usage. While individuals are not penalized for using such titles in social or public settings, violations arise when incorrect or misleading information is submitted to government authorities or the judiciary, reports Al-Rai daily.

According to Al-Sumait, the relevant committee will only approve such changes under clearly defined circumstances. Most notably include cases where the title is already registered in official records such as nationality documents, or where a judicial ruling confirms lineage—particularly in cases involving previously unknown ancestry.

Additional approvals may be granted when there is verified genealogical linkage to a recognized family bearing the title, or in situations where name corrections are required due to past forgery or administrative errors.

The minister emphasized that these measures are designed to ensure the integrity and accuracy of official records, while preventing individuals from acquiring family names or titles without a legitimate legal basis.

The law forms part of broader efforts by authorities to regulate civil documentation, protect family identity, and reinforce confidence in official data systems across the country.
