Kuwait Appeals Court Toughens Sentences in ‘Ya Hala’ Draw Fraud Case

Kuwait’s Court of Appeal has issued a tougher verdict in the high-profile ‘Ya Hala’ commercial draw fraud case, increasing the prison sentence of the main defendant a Ministry of Commerce employee to 15 years, while sentencing 17 other defendants to 10 years in prison each.

The ruling overturns parts of the earlier Criminal Court judgment, reflecting the judiciary’s firm stance against corruption, commercial fraud, and manipulation of public prize draws.

The court found the defendants guilty of charges including bribery, forgery, money laundering, abuse of public office, and manipulation of commercial raffle draws. Prosecutors argued that the network orchestrated fraudulent prize winnings by exploiting insider access and falsifying draw procedures, undermining public confidence in government-supervised promotional campaigns.

In addition to the prison terms, the court upheld substantial financial penalties, including the confiscation of illicit proceeds and fines linked to the money laundering offences. Expatriate defendants will also face deportation after serving their prison sentences, in accordance with Kuwaiti law.

The case, which first came to light following investigations into irregularities in the popular ‘Ya Hala’ prize draws, is one of Kuwait’s largest commercial fraud prosecutions. It involved dozens of defendants accused of conspiring to manipulate raffle results in exchange for financial gains.

The latest appellate ruling significantly increases the punishment for the principal public official involved, reinforcing Kuwait’s broader efforts to combat corruption, protect the integrity of commercial promotions, and strengthen public trust in regulatory institutions.
