KDIPA suspends, delists four foreign companies within two weeks

The Kuwait Direct Investment Promotion Authority (KDIPA) has intensified regulatory oversight of foreign companies operating in the country to ensure full compliance with licensing conditions, particularly requirements related to the employment of national labor.

As part of its latest enforcement measures, KDIPA has temporarily suspended the investment licence of “Shanghai Engineering Company for Electric Power Transmission and Distribution Limited” after the company was found to be in violation of manpower regulations and failing to meet the required quota of Kuwaiti employees.

The authority has granted the company until July 7, 2026, to rectify its status and submit the necessary documentation proving compliance. Failure to do so could result in further penalties, including the possible cancellation of its license.

The decision forms part of KDIPA’s ongoing monitoring strategy aimed at ensuring that foreign investors adhere to the conditions of establishment and operation in Kuwait. Earlier, the authority had cancelled the licenses of three foreign companies following similar compliance reviews.

Informed sources said regulatory bodies are increasingly linking investment incentives and exemptions to the extent of value added to the national economy, including job creation for citizens and knowledge transfer to the local market.

KDIPA continues to emphasize that investment incentives are designed not only to attract capital but also to ensure sustainable economic contribution, including employment opportunities for Kuwaiti nationals.

Under the KDIPA law, foreign investors benefit from a range of incentives, including full or partial foreign ownership, tax exemptions of up to 10 years, customs duty exemptions, allocation of land for projects, and protection against expropriation without fair compensation.

The law also allows for the transfer of capital and profits without restrictions, participation in government tenders based on classification, and the employment of foreign labor in accordance with Cabinet-approved nationalization ratios.
