CAPT upholds KDIPA decision in Al-Na’ayem, Al-Nuwaiseeb tender dispute

The Central Agency for Public Tenders (CAPT) has rejected a complaint filed by a consulting firm over its exclusion from a tender covering feasibility studies for two major development projects in Kuwait, upholding the decision taken by the Kuwait Direct Investment Promotion Authority (KDIPA).

The complaint concerned a tender for preparing a consultancy study to update the feasibility study for the Al-Na’ayem Economic Zone project and a comprehensive feasibility study for the Al-Nuwaiseeb Free Zone project.

Following its review, the CAPT Board of Directors rejected the firm’s complaint, confirming the validity of KDIPA’s decision to exclude it from the tender.

In a related development, the Board was briefed on a decision by the Grievance Committee concerning a separate complaint submitted by another consulting firm over the tender for reviewing the design and supervising the implementation of KDIPA’s new headquarters building.

The project involves the construction, completion, furnishing, maintenance and operation of the authority’s headquarters.

The Grievance Committee accepted the second complaint in form, meaning it met the procedural requirements for consideration, but rejected it on its merits, thereby upholding the position challenged by the consulting firm.

The two decisions concern separate procurement procedures linked to KDIPA, covering consultancy services for the proposed economic and free zones, as well as the authority’s headquarters project.
