Ministry finalizes ‘Digital Trade’ law boosting business and transparency in Kuwait

The Ministry of Commerce finalized the Digital Trade Enabling Law after consultations, incorporating key proposals to support business needs and digital transformation under Kuwait Vision 2035.

The Ministry of Commerce and Industry has finalized the draft of the “Enabling Digital Trade” bill after an extensive consultative process involving input from the business community.

Launched by Minister Khalifa Al-Ajeel on December 4, the initiative aims to create a supportive legislative framework for the digital trade sector. The second draft will soon be submitted to the Fatwa and Legislation Department for review before being presented to the Council of Ministers for approval.

The first draft of the Digital Commerce Enabling Law received 5,602 classified responses and 749 comments from 285 individuals, companies, and government agencies. The feedback indicated a satisfaction rate of 82.2%, with 14.6% providing neutral responses and 3.2% expressing dissatisfaction.

The “Participate in Legislation” survey highlighted key proposals focusing on the preservation of electronic documents, promotional offers, experimental environments, intellectual property rights, and cybersecurity requirements.

The Ministry stated that, based on the suggestions received, the relevant sectors have updated and refined the draft law to incorporate these proposals, ensuring it aligns with the ambitions of the business community.

Moreover, the Ministry emphasized that involving the public in drafting legislation marks a significant development in Kuwait’s legislative process. This approach ensures that laws reflect the needs and aspirations of business owners, professionals, and consumers while promoting transparency, improving legislative quality, and enhancing decision-making.

The Ministry also highlighted the need to broaden the scope of the “Participate in Legislation” initiative to include the development of existing laws and regulations, ensuring they align with the needs of specialists and society. This effort is part of the Ministry’s interim priorities and aims to support digital transformation in line with Kuwait Vision 2035, “New Kuwait.”

The draft law on trade empowerment is part of the Ministry of Commerce and Industry’s interim priorities, aimed at stimulating the Kuwaiti business environment, regulating commercial activity sectors, and empowering business owners.
