Kuwait issues landmark law to regulate disposal of military-type materials

Kuwait has enacted Decree-Law No. 86 of 2025 to regulate the disposal of military-type materials no longer needed by defense authorities.
The explanatory memo noted the absence of a comprehensive legal framework for handling such assets, which had resulted in inefficiencies, unused storage space, and unnecessary costs.
The Al-Rai daily quoting defense sources said, the new legislation aims to streamline the disposal process, maximize returns for the public treasury, and ensure these materials are put to optimal use, whether through sale, transfer, or destruction.
Article 1 defines military-type materials and outlines the scope of the law, while Articles 2 and 3 specify conditions under which materials are deemed outside active use and eligible for disposal. Article 4 lists the entities that may benefit from the law, and Articles 5 through 8 establish the formation and authority of a specialized committee to oversee the process.
The law further details procedures for valuing items (Articles 10–11), public auctions (Articles 12–17), and limited auctions and contract arrangements (Articles 18–19). Articles 20 to 25 outline other disposal methods, including direct sales, exchanges, or destruction.
Articles 26 to 32 contain general provisions, while Article 33 addresses penalties for violations by bidders. Article 34 provides a mechanism for filing grievances against decisions made by the committee.
The executive regulations for implementing the law are to be issued within three months based on a proposal from the Minister of Defense.
