MP Muhannad Al-Sayer has submitted a draft law to amend some provisions of the Penal Code promulgated by Law No. 16 of 1960, after the Constitutional Court ruling that Article 198 of the Penal Code regarding imitating the opposite sex is unconstitutional, for violating Article 30 of the Constitution, which guarantees personal freedom.

Al-Sayer’s proposal stated that the text of Article (198) bis of Law No. (16) of 1960 should be replaced with the following text:

Whoever makes a gesture or an indecent act in a public place, or that someone in a public place sees or hears, or deliberately imitates the opposite sex in the specificity of his sexual characteristics and characteristics that are specific to him without an established medical illness, or who wears clothes that are restricted to him according to the prevailing custom and public morals and customs observed in the country except for cultural purposes in places designated for this, a penalty of imprisonment for a period not exceeding one year and a fine not exceeding one thousand dinars or one of these two penalties shall be imposed.

The investigator or the court, as the case may be, may verify the medical illness, if necessary, through the specialized medical centers.

The court may order that the suspect be subjected to treatment or that he be placed in the places designated for that, as the case may be.

If he returns to acts of imitating the opposite sex within three years from the issuance of the final court verdict finding the person guilty, the penalty is doubled.
