The Ministry of Interior (MoI) outlined the categories under which it is permitted to transfer residency visas, Al Qabas reported.

The clarification came in response to the Ministry of Education’s inquiry about the categories allowed to transfer residency visa. MoI said, “Regarding the application for transferring residency visa to dependent visa, according to Article 22, the applicant must submit to the General Department of Residency Affairs, where each application will be handled separately as well as requests for transfer to Article 24, which is self-sponsorship.”

Under the executive regulations of the Expat’s Residence Law, an expat can avail temporary or regular residency visa permit if born in Kuwait, or who entered the country according to the provisions of the articles, stated MoI.

The residency permit may be transferred from one type to another, and from one purpose to another, according to the regulations set by the General Department of Residency Affairs, and the duration by which he or she is permitted to stay in the country is related to the purpose of the visa and ends with the end of that purpose, even if that is before the end of its term.

Regarding Visa transfers within government agencies, in accordance with Article 17, will be subject to the following stipulations, which is the approval provided by the entity where the expat was employed, and the other party that wants to appoint him to a vacancy, in addition to the approval of the Civil Service Bureau.

As for a visa transfer from the government sector to the private sector, according to Article 18, the expat must obtain a work permit from the Public Authority for Manpower (PAM), and the job to which he will be employed must be a similar profession in which he was working in the government sector, with the applicant having the required specialization and the qualifications for the profession.

And lastly, for transferring from government to family visa, a work permit from the PAM is required. Approval of the authority where he is employed, approval of the entity wishing to appoint him, and approval of the Civil Service Bureau is also required.
