The Prime Minister, His Highness Sheikh Sabah Al-Khaled Al-Hamad Al-Sabah has issued a decision detailing the rules and regulations for accepting and distributing gifts and donations to the governorates.

The decision stated that the governor may accept gifts and donations from individuals and Kuwaiti governmental and non-governmental entities, or those affiliated with sisterly or friendly countries, with the aim of establishing or developing projects, or improving services within the governorate, reported an Arabic daily.

According to the decision, which was published today in the Official Gazette ‘Kuwait Al-Youm’, donations and gifts may be in cash or in kind, and their acceptance should be under the following conditions:

1 – Not to prejudice the unity and sovereignty of the state and the stability of society.

2 – That the goal of the donation is legitimate, and does not violate public order and does not contradict Islamic values.

3 – The donor does not obtain any advantages or priorities in obtaining the services provided by the governorate.

The decision prohibits the governorate from requesting gifts or donations, with the exception of invitations in which the governorate requests sponsoring conferences, seminars, celebrations and events that it organizes inside Kuwait.

The decision stipulates that the donor must submit an application to the governorate wishing to donate, on the prescribed form prepared by each governorate, and the request must include the following data:

1 – The name of the person or entity giving gifts or donations.

2 – Type of gifts or donations.

3 – The purpose of the gifts or donations, if any, provided that a copy of the documents of the gifts or donations in kind and any other documents related to it are attached to the application.

The decision indicates that a committee is formed by a decision of the governor to study the request for the gift or donation, and the committee must prepare a report that must include all the procedures it has taken and indicate the extent to which the request meets the procedural and objective requirements stipulated in this decision and its recommendation to accept or reject it.

The committee must submit its report to the governor accompanied by all documents and the documents that were submitted to it, and the governor has the right to give initial approval to accept or reject the application and to refer the application and all documents to the Council of Ministers for its opinion.

The resolution authorizes the donor to request allocating the value of the donations provided by him or part of it to spend on a specific project or service within the scope of the services in governorate.

The decision states that cash donations are included in the appropriations of each governorate within the governorate’s affairs program in the budget of the Council of Ministers, and they are disbursed and monitored in accordance with the provisions of Law No. 31 of 1978 referred to and the decisions and circulars issued in this regard, provided that the in-kind donations are transferred to the governorate as an endowment regulating this matter.
