The Criminal Court led by Judge Abdullah Jassim Al-Abdullah passed a significant judicial ruling that annulled the inspection conducted by an officer in a house in the night, which was a violation of the search warrant issued by the Public Prosecution, Aljarida daily reported.

According to the case file, the Public Prosecution charged two defendants with possession of narcotic substances with intent to consume, and possession of weapons and ammunition. The Court of First Instance had sentenced one of the accused to five year imprisonment with hard labor, and acquitted the other from all charges leveled against him.

The court stated that the warrant issued to the officer did not include the possibility for organizing a search at night, as such searches at night are permitted only on necessity and other factors, which is why it should have mentioned in the warrant.

The court also considered the ruling of the Court of Appeals as invalid as the decision was passed in the absence of the defendant, and noted that there was no adherence to the proper notification procedure, which was not fully and properly implemented.
