Kuwait protects key rights for Article Five persons affected by nationality withdrawal

To balance reform and stability, Cabinet moves to safeguard their jobs, licenses and benefits

In a move reflecting efforts to balance legal enforcement with social and economic stability, the Kuwaiti government has approved the continuation of certain rights and privileges for individuals whose citizenships were withdrawn under specific provisions of the Kuwaiti Nationality Law.

The decision, issued by the Council of Ministers, applies to those who had obtained nationality under Article Five, often referred to as the “distinguished services” category, as well as those who acquired it by dependency, in accordance with Amiri Decree No. 15 of 1959 and its amendments.

Government sources indicated that several ministries and public institutions have been instructed to implement measures aimed at preserving employment, business continuity, and access to essential services for affected individuals, reports Al-Rai daily.

Business Continuity Measures

Authorities, including the Ministry of Commerce and Industry, have been directed to allow companies impacted by the withdrawal of nationality, whether involving owners or partners, to continue operating. However, restrictions have been imposed, prohibiting any increase in ownership stakes or the establishment of new companies under the same category.

Employment and Financial Support

The government will continue to provide employment support benefits to eligible individuals, while the Public Institution for Social Security has been tasked with ensuring the disbursement of pension shares to heirs of beneficiaries covered under this category, in line with Article 104 of the Social Insurance Law.

Healthcare and Professional Licensing

The Ministry of Health has also been instructed to facilitate the continuation of operations for affected individuals working in the medical sector. This includes the renewal of professional licenses for owners of clinics, hospitals, and related healthcare businesses, ensuring uninterrupted service delivery.

Public Sector Employment

The Cabinet had previously approved allowing individuals within this category to remain employed in government entities and state-owned companies under contractual arrangements issued by the Civil Service Bureau. However, they are not permitted to occupy leadership or supervisory positions.

Policy Context

The measures reflect a broader approach aimed at mitigating the socioeconomic impact of nationality withdrawal decisions, while maintaining regulatory controls. By preserving selected privileges, authorities seek to support economic activity, protect livelihoods, and ensure continuity in vital sectors without expanding legal entitlements.

The policy underscores Kuwait’s attempt to strike a careful balance between enforcing nationality regulations and maintaining institutional and economic stability.
