MoSA calls on Municipality to enforce laws against violating charity branches

The Ministry of Social Affairs has formally requested the Kuwait Municipality to address and rectify violations committed by branches and committees affiliated with public benefit associations and charitable foundations that are of a civil and charitable nature.
The Ministry emphasized the importance of enforcing existing laws on all such violations occurring within private and model residential areas, according to Al-Rai daily.
This directive was outlined in an official letter sent by the Undersecretary of the Ministry of Social Affairs, Dr. Khaled Al-Ajmi, to the Municipality. The letter reaffirmed the Ministry’s commitment to exercising its supervisory and regulatory role over charitable activities across the country, in accordance with Law No. (24) of 1962 concerning clubs and public benefit associations.
The Ministry also cited Ministerial Resolution No. (2009/206), which regulates construction and prohibits the use of private residential buildings in designated residential zones for any non-residential purposes.
Furthermore, the Ministry urged strict adherence to the provisions of the aforementioned resolution, particularly in relation to charitable organizations that have established their headquarters or branches within residential neighborhoods. The Ministry stressed that such practices contravene existing laws and should be addressed promptly.
In addition, the Ministry called for the activation of Cabinet Decision No. (867) (second) of 2001, issued during session No. (2001/36) held on July 10, 2001. Specifically, Clause No. (2) of this decision mandates the proper legal classification of committees and branches in a manner that facilitates the correction of their legal status and ensures compliance with applicable regulations.
The Ministry concluded by emphasizing the need for coordinated efforts between relevant authorities to apply the law uniformly and eliminate all forms of unauthorized activities within residential zones.
