New decree expands Prosecutor’s authority over conditional release of inmates

A new Decree-Law No. (64) of 2025 has been issued, amending Article 91 of the Penal Code (Law No. 16 of 1960), enhancing the legal framework governing the conditional release of convicts.

According to the amended Article 91, the Public Prosecutor is now authorized to issue a release order based on a request submitted by the Minister of Interior or their representative, reports Al-Rai daily.

This decision must follow a recommendation from a specialized committee formed by the Minister of Interior. The committee, comprising representatives from both the Public Prosecution and the Ministry of Interior, is tasked with reviewing release requests.

The committee must confirm that the inmate’s behavior during imprisonment reflects genuine reform and that their release poses no threat to public security. Should circumstances change, the release may be revoked by the Public Prosecutor, again based on a request from the Interior Ministry and following the committee’s recommendation.

This amendment aims to balance rehabilitation with public safety through a structured and accountable review process.
