Minister of Justice issues new regulation on expert fees, doubling rates for high-value cases

In a move aimed at enhancing transparency and improving the compensation structure for judicial experts, Minister of Justice and Minister of Awqaf and Islamic Affairs, Counselor Nasser Al-Sumait, has issued a ministerial decision regulating and defining the fees of experts affiliated with the General Administration of Experts.

The new regulation expected to take effect from July 1, 2025 outlines a detailed structure for calculating expert fees based on the time and effort involved in each mission, reports Al-Rai daily.

It sets fixed rates for specific services such as 10 dinars per session held at the administration’s headquarters; 30 dinars for inspection visits or off-site sessions, including reviewing papers outside the headquarters; 20 dinars for court appearances to discuss the expert report; 15 dinars as transportation allowance; 20 dinars for submitting the final report and 5 dinars for procedural sessions held without the presence of disputing parties.

In cases where the expert’s report leads to financial findings equal to or exceeding 500,000 dinars, the decision mandates a 100% increase in fees, subject to court approval. For cases requiring specialized knowledge beyond the scope of the General Administration of Experts, the matter will be referred to the court to determine suitable compensation.

The decision also introduces a tiered fee structure for real estate-related missions conducted by “knowledge” experts — 100 dinars for cases involving private residences, chalets, or commercial shops; 200 dinars for assessments related to industrial or agricultural plots and 250 dinars for evaluations of residential or commercial complexes.

This regulation marks a significant step toward enhancing governance, fairness, and professionalism in the delivery of judicial expert services, especially in high-value or technically complex legal disputes.
