Kuwait forms committee to revise criminal procedures and trials law

As part of its ongoing plan to modernize the legislative system, Kuwait’s Ministry of Justice has announced the formation of a committee to review and develop the Criminal Procedures and Trials Law.

The decision, issued by Minister of Justice Counselor Nasser Al-Sumait, aims to address gaps revealed through practical application, particularly regarding pretrial detention, appeals, and enforcement of judgments.

The committee will also explore alternatives to criminal prosecution to reduce the burden on courts and the Public Prosecution. In a statement to KUNA, Counselor Al-Sumait explained that the team will examine the current law and compare it with modern international legislation to prepare a comprehensive draft that balances constitutional principles, individual rights, and societal guarantees.

“The committee will focus on simplifying procedures, expediting case adjudication, and updating legal texts to reflect technological developments in investigation, control, and evidence, while ensuring legitimacy and protection of constitutional rights,” Al-Sumait said.

The committee is headed by Attorney General Counselor Dr. Omar Al-Masoud and includes Counselors at the Court of Appeal Saud Al-Mutairi, Ahmed Al-Sadi, and Khaled Al-Tahous; Head of the Ministry of Justice Technical Office Counselor Dr. Obaid Al-Asimi; Kuwait University representative Dr. Khaled Al-Rashidi; Ministry of Interior legal officer Lieutenant Colonel Suleiman Al-Omran; Lawyers Association representative Lawyer Mohammed Khuraibat; and Yousef Al-Mansour from the Ministry of Justice as rapporteur.

The committee is scheduled to submit a final report outlining proposed amendments along with a comparative table of current and new legal texts, paving the way for completion of the necessary constitutional procedures.

Al-Sumait emphasized that this initiative reflects the ministry’s commitment to modernizing legislation, promoting prompt justice, and reinforcing Kuwait’s leading role in upholding the rule of law and safeguarding rights and freedoms.
