“Justice Ministry” prohibits issuance of irrevocable real estate agencies

The Undersecretary of the Ministry of Justice, Tariq Al-Asfour, issued a circular banning the issuance of irrevocable or non-cancelable real estate agencies.
The circular stated that the Real Estate Registration and Documentation Sector will amend the data of all non-revocable or non-cancellable real estate agencies registered at the time of the circular’s issuance, converting them into final sales contracts in the Ministry’s automated systems starting Sunday, 2nd February, 2025.
Importantly, all legal effects will be applied based on the fixed capacities in the Ministry’s systems, and relevant parties, including the Public Institution for Housing Welfare, the Kuwait Credit Bank, and others, will be notified.
The circular stipulated that to issue a property ownership document in the name of the person benefiting from a non-revocable or non-cancellable real estate agency, the following documents must be submitted:
- The origin of the real estate agency.
- Original property document.
- A description certificate and a property identification letter issued by the Kuwait Municipality.
In December 2024, Minister of Justice Nasser Al-Sumait issued a decision to implement the executive regulations for Law No. 125 of 2023, which regulates real estate agencies.
The law set a one-year period for resolving issues related to non-revocable or non-cancellable real estate agencies, ending on January 31, 2025. If the situation is not settled by then, the agency will be considered a final sales contract.
