CMA pushes market modernization; judicial powers assigned to staff

Imad Tifouni, Chairman of the Board of Commissioners of the Capital Markets Authority (CMA), has issued Resolution No. 92 of 2025, marking a key step in the development of the post-trade infrastructure within Kuwait’s capital market.

The resolution was issued following a review of Law No. 7 of 2010, which governs the establishment of the CMA and the regulation of securities activities, along with its subsequent amendments, reports Al-Jarida daily.

According to Article 5 of the resolution, the relevant authorities are instructed to implement the decision within their respective jurisdictions. It will come into effect upon the launch of the second part of the third phase of the market development project — with the implementation date to be announced by the CMA at a later stage.

This move is part of the broader strategic efforts to modernize Kuwait’s financial markets and enhance operational efficiency in line with international best practices.

Meanwhile, Minister of Commerce and Industry Khalifa Al-Ajeel issued Ministerial Resolution No. 95 of 2025, granting judicial police powers to a number of CMA employees.

Under the resolution, approximately 37 officers were authorized with the capacity to investigate and document violations of Law No. 7 of 2010, as well as its executive regulations and amendments.

These judicial officers are empowered to enter the premises of companies operating in the securities sector, including stock exchanges and affiliated entities, and to examine records, books, documents, digital data, tapes, and computer systems necessary to uncover any infringements.

The dual decisions reflect a reinforced commitment by the Kuwaiti government and the CMA to strengthen market oversight, ensure regulatory compliance, and uphold transparency and investor protection across all sectors of the capital market.
