Al-Roumi proposal seeks to link temporary storage licenses to project contract duration

Municipal Council member Farah Al-Roumi has submitted a proposal to amend an article in the administrative decision regulating the conditions, procedures and controls for issuing and renewing temporary storage licenses.

Al-Roumi said the proposal comes in response to recurring challenges faced by entities implementing infrastructure and construction projects in Kuwait, whether government or private sector.

Based on observations from regulatory authorities, contracting companies and relevant ministries, she noted that there is a regulatory gap and overlap in how the duration of temporary storage licenses is determined, reports Al-Rai daily.

She explained that current procedures often lead to disruptions in engineering work when storage permits expire in the middle of a project, even though the main contract remains valid.

Contractors are also required to repeatedly submit renewal requests throughout the implementation period, increasing administrative burdens. In addition, the absence of a unified reference linking the contractual duration of a project to the actual need for a storage site, along with unclear renewal controls, opens the door to varying interpretations and weakens oversight.

Al-Roumi said a draft resolution has been prepared that introduces a legislative text to the system regulating temporary storage activities. The aim is to strike a balance between facilitating work for contractors and implementing authorities, while maintaining proper control over the use of land and temporary public sites.

The proposal calls for amending Article Two of the decision, replacing Clause (1) of Article Four with a provision stating that the validity of a temporary storage license for projects implemented under commercial, civil or administrative contracts should match the project’s original contractual period, as documented in official papers approved by the project owner or supervising authority.

She added that the storage license may be renewed more than once, provided each renewal does not exceed one year, in accordance with the decision’s conditions, and based on a request from the implementing entity and the approval of the competent authorities.

The proposed amendment is intended to create a clearer regulatory framework that supports project continuity while preserving administrative and land-use controls.
