Court upholds 9.55 million dinars ruling against Agility over Sulaibiya warehouses

Agility plans to appeal the verdict at the Court of Cassation

Kuwait Bourse has published on its official website on Thursday, January 22, 2026, a disclosure by Agility Public Warehousing Company K.S.C.P. (Agility) news about a judicial ruling related to the Sulaibiya warehouses.

According to the disclosure, dated January 21, 2026, the case concerns an appeal filed by Agility against the first-instance court verdict on the termination of Allocation Contract No. (2002/60) for the Sulaibiya warehouses, the company’s eviction from the site, and its obligation to pay usage fees to the Public Authority for Industry (PAI) for the period following the end of the contractual relationship.

The appeal, registered under Case No. 7455/2025 (Commercial Civil – Government Appeals), challenged an earlier ruling issued in Case No. 6460/2024 (Commercial Civil – Government, First Instance), reports Al-Anba daily.

The Court of Appeal (Commercial Civil – Government) ruled in favor of the Public Authority for Industry, rejecting both appeals and upholding the court of first-instance judgment. The court ordered each appellant to bear the costs of their appeal, in addition to 100 dinars for actual legal fees.

Under the court of first-instance ruling, Agility was ordered to pay the Public Authority for Industry 9,549,802.333 dinars as compensation for the right of use for the period from April 24, 2022, to October 2025, along with court expenses and 300 dinars in actual attorney fees. All other claims were dismissed.

Agility stated that it intends to challenge the ruling before the Court of Cassation within the legally prescribed timeframe. As such, while the judgment is final, it is not yet conclusive, pending cassation proceedings. The company said it will disclose any material developments in due course.
