Commerce issues decision to streamline business licensing effective Oct 1

The Minister of Commerce and Industry, Dr. Abdullah Al-Salman, has issued a decision stipulating an exception to permit licensing of shops, companies and commercial establishments that practice trade in Kuwait through stores and points of sale or through websites and electronic applications for seasonal and emergency offers.

The ministerial decision, which will come into effect on October 1, introduces amendments to some provisions of the executive regulations for consumer protection, licensing the linking of the price of the goods of companies and commercial establishments on websites and electronic applications to the prices of foreign and international sites and applications, based on a request submitted to the ministry of commerce in accordance with the terms and controls issued by a decision made by the Undersecretary of the Ministry or his authorized representative, and the duration of the license in this case is 6 months, subject to extension.

The decision added Article No. (32) bis to the regulation on licensing fees for emergency seasonal offers, as it was decided that they would be 250 dinars for each store, exhibition or website, 50 dinars for each selling point belonging to the licensee, and 25 dinars for each point of sale of others.

It also set a price of 250 dinars for linking the local price to the prices of foreign and international websites and electronic applications, and 250 dinars per month for cash-back offers, provided that the license is issued in the form approved by the ministry, including any special requirements and controls related to the type of the required license.

The decision stipulates in its article (5) that Article No. (32) bis should be added to the executive regulations of the Consumer Protection Law, provided that its text is as follows: “Shops, companies and commercial establishments that offer cash-back offers must obtain a license from the competent department, based on an application submitted to the (Ministry of Commerce) in accordance with the conditions and controls issued by a decision of the Undersecretary of the Ministry or his authorized representative, and the license period in this case is 6 months, subject to extension.
